The U.S.'s Foreign Corrupt Practices Act (FCPA) was enacted almost 50 years ago for the purpose of making it unlawful for certain classes of persons and entities to make payments to foreign government officials to assist in obtaining or retaining business.
On February 10, the Trump Administration issued an executive order pausing the FCPA for at least 180 days in order to review current enforcement actions and update guidelines and policies. The Administration's reasoning is that overexpansive and unpredictable
FCPA enforcement against American citizens and businesses for routine business practices in other nations actively harms American economic competitiveness and, therefore, national security. This pause has created some confusion for businesses conducting
government contract work outside of the U.S.
